Terms of Use — EbMath

These Terms of Use govern access to and use of the EbMath app, website and web dashboard (together, the PLATFORM), operated by Prescott Hub. By creating an account or using the PLATFORM, you declare that you have read, understood and accepted these Terms. If you do not agree with them, do not use the PLATFORM.

If you are under 18: use of the PLATFORM requires authorization from your parent or legal guardian, who also accepts these Terms on your behalf.

1. What the PLATFORM is — and what it is not

The PLATFORM is a tool to support the practice of basic mathematics, using spaced repetition to schedule reviews of number facts at the moment they tend to be forgotten.

The PLATFORM does not replace school instruction, professional pedagogical guidance, or any educational, psychological or health assessment or diagnosis.

We do not guarantee learning outcomes. Each student's performance depends on frequency of use, school context and individual factors beyond our control.

2. Access profiles

• Classroom student: signs in with codename, password and class code. Authorization is granted by the school as part of its pedagogical plan.
• Independent student: signs in by email or Google account, with authorization from a parent or legal guardian.
• Teacher: accesses the web dashboard with email, password and mandatory two-factor authentication.
• Researcher: accesses through specific credentials and a research agreement.

3. Registration and account

• You agree to provide accurate information and keep it up to date.
• Your password is personal and non-transferable. You are responsible for activity carried out with your account.
• Each account allows up to 5 simultaneous sessions on different devices. Signing in on a new device does not end previous ones; when the limit is exceeded, the oldest session is closed.
• Notify us immediately of any unauthorized use of your account.

4. Permitted and prohibited use

The following are expressly prohibited:

• using automation, bots, scripts or modified versions of the app to simulate answers, accumulate coins or circumvent game mechanics;
• attempting to access third-party accounts, classes or data;
• reverse engineering, decompiling or extracting the PLATFORM's source code;
• copying, reproducing or distributing the PLATFORM's pedagogical content without written authorization;
• overloading the infrastructure or exploiting vulnerabilities;
• using the PLATFORM for unlawful purposes or in violation of third-party rights.

Consequence: suspension or termination of the account, with no refund of amounts paid and without prejudice to applicable legal measures. To preserve the pedagogical and scientific validity of the data, records with response times incompatible with human completion of the exercise may be discarded.

5. Gamification, coins and virtual items

• Lives, coins, items and avatars are virtual game elements, with no monetary value, not convertible into money and not transferable between accounts.
• We may adjust gamification rules, values and item availability at any time, for pedagogical or operational reasons.
• Closing the account extinguishes virtual items, with no right to compensation.

6. Subscriptions and payments

• Pedagogical use of the PLATFORM is free of charge.
• The optional subscription, where available, is purchased exclusively through the app store. Billing, renewal, cancellation and refunds follow that store's rules.
• School licenses are contracted directly with us, under a separate agreement, not through the app store.

7. Advertising

To keep the PLATFORM free, the non-subscription version may display advertising. In that case:

• ads are non-personalized, with no behavioral tracking of the user;
• only general-audience rated ads are allowed to load;
• ads are never displayed during exercises, so as not to harm the student's concentration;
• where an optional ad grants an in-game benefit, viewing it depends on a deliberate user action and is never a condition for continuing to learn.

We are not responsible for the content, products or services of third-party advertisers. Contracted school licenses display no advertising.

8. Intellectual property

• All PLATFORM content — software, code, brand, visual identity, learning tracks, exercises, methodology, texts, images and sounds — belongs to the operator or to third-party licensors, protected by Brazilian Laws 9,279/1996, 9,609/1998 and 9,610/1998.
• We grant you a personal, limited, revocable, non-exclusive and non-transferable license for the purposes set out in these Terms. No other rights are transferred.
• Third-party resources used under open licenses are credited on the PLATFORM's credits screen.

9. Personal data and privacy

• Data processing is governed by the Privacy Policy, which forms part of these Terms.
• Classroom students sign in with a codename: we do not request email, phone, national ID or address from children in this flow.
• You may request account deletion at any time. The account is deactivated immediately and permanently anonymized after 30 days. Signing in again within that period cancels the request and restores the account.
• Anonymized pedagogical history may be retained for statistical and research purposes, with no identification of the data subject.

10. Availability and offline mode

• The PLATFORM works without a connection, and progress is synchronized as soon as connectivity is restored.
• We do not guarantee uninterrupted availability. Service may be interrupted for maintenance, updates or third-party failures.
• We recommend keeping the app updated. We do not support discontinued versions.

11. Limitation of liability

We are liable within the limits of the Brazilian Consumer Protection Code. We are not liable for: connection or device failures on the user's side; loss of progress caused by uninstalling, changing devices or improper use; the content of ads served by third parties; or pedagogical decisions made by schools and teachers based on PLATFORM reports.

Nothing in these Terms excludes liability that the law does not allow to be excluded.

12. Suspension and termination

• You may close your account at any time, through the app or the contact email.
• We may suspend or terminate accounts that violate these Terms, with prior notice, except where the severity of the conduct or the law requires immediate action.

13. Changes to these Terms

• These Terms may be amended. Material changes will be communicated 30 (thirty) days in advance, in the app and by email where available.
• Continued use after the change takes effect implies acceptance. If you do not agree, you may close your account.

14. Contact, governing law and jurisdiction

• Brazilian law applies.
• Where the user is a consumer, the courts of their domicile shall have jurisdiction. Otherwise, the courts of the operator's registered seat.
